Art. 1 – Disposizioni Generali

La navigazione e la trasmissione di un ordine di acquisto sul sito comportano l’accettazione delle Condizioni e delle Politiche di Protezione dei Dati adottate dal sito stesso ivi indicate.

Le presenti Condizioni Generali di Vendita si applicano alla vendita di prodotti con esclusivo riferimento agli acquisti effettuati sul sito conformemente alle disposizioni della Parte III, Titolo III, Capo I, Codice del Consumo (D.lgs. n. 206/05 modificato dal D.lgs. n. 21/14 e D.lgs. 70/03) da parte di

3. L’utente è tenuto, prima di accedere ai prodotti forniti dal sito, a leggere le presenti Condizioni Generali di Vendita che si intendono generalmente ed inequivocabilmente accettate al momento dell’acquisto.

4. Si invita l’utente a scaricare e stampare una copia del modulo d’acquisto e delle presenti Condizioni Generali di Vendita i cui termini BIKEE BIKE SRL si riserva di modificare unilateralmente e senza alcun preavviso.

Art. 2 – Oggetto

1. Le presenti Condizioni Generali di Vendita disciplinano l’offerta, l’inoltro e l’accettazione di ordini d’acquisto di prodotti su BIKEE BIKE SRL e non disciplinano, invece, la fornitura di servizi o la vendita di prodotti da parte di soggetti diversi dal venditore che siano presenti sul medesimo sito tramite link, banner o altri collegamenti ipertestuali.

2. Prima di inoltrare ordini ed acquistare prodotti e servizi da soggetti diversi, suggeriamo di verificare le loro condizioni di vendita.

Art. 3 – Conclusione Del Contratto

1. Per concludere il contratto di acquisto, sarà necessario compilare il formulario in formato elettronico e trasmetterlo seguendo le relative istruzioni.

2. In esso sono contenuti il rinvio alle Condizioni Generali di Vendita, le immagini di ciascun prodotto ed il relativo prezzo, i mezzi di pagamento che è possibile utilizzare, le modalità di consegna dei prodotti acquistati e i relativi costi di spedizione e consegna, un rimando alle condizioni per l’esercizio del diritto di recesso; modalità e tempi di restituzione dei prodotti acquistati.

3. Prima di concludere il contratto, sarà chiesto di confermare l’avvenuta lettura delle Condizioni Generali di Vendita comprensive dell’Informativa sul diritto di recesso e del trattamento dei dati personali.

4. Il contratto è concluso quando il venditore riceve il formulario compilato dall’utente, previa verifica della correttezza dei dati ivi contenuti, ed il pagamento del prezzo corrispettivo.

5. Concluso il contratto, il venditore prende in carico l’ordine per la sua evasione.

Art. 4 – Utenti Registrati

1. Nel completare le procedure di registrazione, l’utente si obbliga a seguire le indicazioni presenti sul sito e a fornire i propri dati personali in maniera corretta e veritiera.

2. La conferma esonererà in ogni caso BIKEE BIKE SRL da ogni responsabilità circa i dati forniti dall’utente. L’ utente si obbliga a informare tempestivamente BIKEE BIKE SRL di qualsiasi variazione dei propri dati in ogni tempo comunicati.

3. Qualora poi l’utente comunichi dati non esatti o incompleti ovvero anche nel caso in cui vi sia contestazione da parte dei soggetti interessati circa i pagamenti effettuati, BIKEE BIKE SRL avrà facoltà di non attivare ovvero di sospendere il servizio fino a sanatoria delle relative mancanze.

4. In occasione della prima richiesta di attivazione di un profilo da parte dell’utente, BIKEE BIKE SRL attribuirà allo stesso nome utente ed una password. Quest’ultimo riconosce che tali identificativi costituiscono il sistema di validazione degli accessi dell’utente ai Servizi ed il solo sistema idoneo ad identificare l’utente che gli atti compiuti mediante tale accesso saranno a lui attribuiti e avranno efficacia vincolante nei suoi confronti.

5. L’utente si obbliga a mantenerne la segretezza dei suoi dati d’accesso e a custodirli con la dovuta cura e diligenza e a non cederli anche temporaneamente a terzi.

Art. 5 – Disponibilità Dei Prodotti

1. La disponibilità dei prodotti si riferisce alla disponibilità effettiva nel momento in cui l’utente effettua l’ordine. Tale disponibilità deve comunque essere considerata puramente indicativa perché, per effetto della contemporanea presenza sul sito di più utenti, i prodotti potrebbero essere venduti ad altri clienti prima della conferma dell’ordine.

2. Anche in seguito all’invio dell’e-mail di conferma dell’ordine potrebbero verificarsi casi di indisponibilità parziale o totale della merce. In questa eventualità, l’ordine verrà rettificato automaticamente con l’eliminazione del prodotto non disponibile e l’utente verrà immediatamente informato via e-mail.

3. Se l’utente richiede l’annullamento dell’ordine, risolvendo il contratto, BIKEE BIKE SRL rimborserà l’importo pagato entro 15 giorni a partire dal momento in cui BIKEE BIKE SRL ha avuto conoscenza della decisione dell’acquirente di risolvere il contratto.

Art. 6 – Prodotti Offerti

Art. 7 – Modalità Di Pagamento E Prezzi

1. Il prezzo dei prodotti sarà quello indicato di volta in volta sul sito, salvo laddove sussista un errore palese.

2. In caso di errore BIKEE BIKE SRL avviserà prima possibile l’acquirente consentendo la conferma dell’ordine al giusto importo ovvero l’annullamento. Non sussisterà ad ogni modo per BIKEE BIKE SRL l’obbligo di fornire quanto venduto al prezzo inferiore erroneamente indicato.

3. I prezzi del sito sono comprensivi di IVA e non includono le spese di spedizione. I prezzi possono subire variazioni in qualsiasi momento. I cambiamenti non riguardano gli ordini per i quali sia stata già inviata conferma dell’ordine.

4. Una volta selezionati i prodotti desiderati, essi saranno aggiunti al carrello. Sarà sufficiente seguire le istruzioni per l’acquisto, inserendo o verificando le informazioni richiMantova in ogni passaggio del processo. I dettagli dell’ordine potranno essere modificati prima del pagamento.

5. Il pagamento può essere effettuato tramite:

Art. 8 – Consegna

1. BIKEE BIKE SRL effettua spedizioni in tutto il territorio italiano.

2. BIKEE BIKE SRL effettuerà solamente consegne presso il domicilio dell’utente, fornito al momento dell’acquisto.

3. La consegna viene effettuata generalmente entro 3-5 GIORNI LAVORATIVI per i prodotti disponibili

4. Qualora la consegna non possa avere luogo per cause a noi non imputabili dopo trenta giorni dalla data in cui l’ordine è disponibile per la consegna, assumeremo che si intenda risolvere il contratto.

5. In conseguenza della risoluzione gli importi saranno restituiti, esclusi i costi di consegna. Il trasporto derivante dalla risoluzione del contratto potrebbe avere costi addizionali che saranno a carico dell’acquirente.

6. Le spese di spedizione sono a carico dell’acquirente e sono evidenziate esplicitamente al momento dell’effettuazione dell’ordine.

Art. 9 – Passaggio Del Rischio

1. I rischi relativi ai prodotti passeranno a carico dell’acquirente a partire dal momento della consegna. La proprietà dei prodotti si considera acquisita appena ricevuto il pagamento completo di tutti gli importi dovuti in relazione agli stessi, incluse le spese di spedizione, ovvero al momento della consegna, se questa avvenisse in un secondo momento.

Art. 10 – Garanzia E Conformità Commerciale

1. Il venditore è responsabile per qualsiasi difetto dei prodotti offerti sul sito, ivi inclusa la non conformità degli articoli ai prodotti ordinati, ai sensi di quanto disposto dalla normativa italiana.

2. Se l’acquirente ha stipulato il contratto in qualità di consumatore ovverosia qualsiasi persona fisica che agisca sul sito per scopi estranei all’attività imprenditoriale o professionale eventualmente svolta, la presente garanzia è valida a condizione che il difetto si manifesti entro 24 mesi dalla data di consegna dei prodotti; che l’acquirente presenti reclamo formale relativamente ai difetti entro un massimo di 2 mesi dalla data in cui il difetto è stato da quest’ultimo riconosciuto; che venga compilato correttamente il modulo di reso online.

3. In caso di mancata conformità, l’utente che ha stipulato il contratto in qualità di consumatore avrà diritto ad ottenere il ripristino della conformità dei prodotti senza spese, mediante riparazione o sostituzione, ovvero di ottenere un’appropriata riduzione di prezzo ovvero la risoluzione del contratto relativamente ai beni contestati e la conseguente restituzione del prezzo.

4. Tutti i costi di restituzione per prodotti difettosi saranno sostenuti dal venditore.

Art. 11 – Recesso

1. Conformemente alle disposizioni legali in vigore, l’acquirente ha diritto di recedere dall’acquisto senza alcuna penalità e senza specificarne il motivo, entro il termine di 30 giorni ai sensi dell’art. 57 del D.lgs 206/2005 decorrenti dalla data di ricezione dei prodotti.

2. In caso di acquisti multipli effettuati dall’acquirente con un solo ordine e consegnati separatamente, il termine decorre dalla data di ricezione dell’ultimo prodotto.

3. L’utente che intendesse esercitare il diritto di recesso dovrà comunicarlo a BIKEE BIKE SRL tramite dichiarazione esplicita, che potrà essere trasmessa a mezzo raccomandata A/R all’indirizzo:

4. L’acquirente dovrà esercitare il diritto di recesso anche inviando una qualsiasi dichiarazione esplicita contenente la decisione di recedere dal contratto oppure alternativamente trasmettere il modulo di recesso tipo, di cui all’Allegato I, parte B, D.Lgs 21/2014 non obbligatorio.

6. La merce dovrà essere restituita integra, nella confezione originale, completa in tutte le sue parti e completa della documentazione fiscale annessa. Fatta salva la facoltà di verificare il rispetto di quanto sopra, Bikee Bike srl provvederà a rimborsare l’importo dei prodotti oggetto del recesso entro un termine massimo di 10 giorni.

7. I costi sostenuti per la restituzione della merce saranno a carico dell’utente.

8. Come previsto dall’art. 56 comma 3 del D.Lgs 206/2005, modificato dal D.lgs 21/2014 Bikee Bike srl può sospendere il rimborso fino al ricevimento dei beni oppure fino all’avvenuta dimostrazione da parte dell’acquirente di aver rispedito i beni.

9. Non si applicherà il diritto di recesso nel caso in cui i servizi e prodotti di BIKEE BIKE SRL sono inclusi nelle categorie dell’art. 59 del D.Lgs 206/2005.

10. Bikee Bike srl eseguirà il rimborso utilizzando lo stesso mezzo di pagamento scelto dal l’acquirente in fase di acquisto. Nel caso di pagamento effettuato con bonifico, e qualora l’utente intenda esercitare il proprio diritto di recesso, dovrà fornire le coordinate bancarie: IBAN, SWIFT e BIC necessari all’effettuazione del rimborso.

Art. 12 – Trattamento Dei Dati

1. Utilizzando il sito l’utente autorizza il trattamento dei suoi dati personali. La presente informativa ha valore anche ai fini dell’articolo 13 del Regolamento UE n. 2016/679, relativo alla protezione delle persone fisiche con riguardo al trattamento dei dati personali nonché alla libera circolazione di tali dati.

4. Il trattamento dei dati avviene in forma esclusivamente elettronica, attraverso strumenti e supporti informatici atti ad assicurare la sicurezza e riservatezza dei dati medesimi. Le informazioni immagazzinate sono protette da accessi non autorizzati.

5. Si procede al trattamento dei dati forniti dagli utenti relativamente agli ordini di acquisto, ai pagamenti (che possono contenere nome, indirizzo, recapiti), indirizzo IP, tutti gli altri dati comunicati.

6. La finalità dell’utilizzazione di tali dati è l’esecuzione dell’ordine di acquisto e dei pagamenti, la comunicazione dei dati stessi a terzi fornitori dei servizi di pagamento, di spedizione nonché i contatti di natura informativa circa le attività e i servizi del sito, offerte di natura commerciale delle società affiliate e partners commerciali.

Il conferimento dei dati ed il consenso al trattamento per le finalità di cui allo scopo del contratto ovvero l’evasione dell’ordine ed il relativo pagamento è necessario alla conclusione stessa nonché all’esecuzione del contratto. Pertanto, il rifiuto di fornire tali dati o di prestare il consenso al relativo trattamento ha come conseguenza l’impossibilità per l’utente di acquistare i prodotti e i sevizi di offerti.

8. Il conferimento dei dati ed il consenso al trattamento per le finalità di comunicazioni commerciali è facoltativo. Tuttavia, un eventuale rifiuto di fornire tali dati o di prestare il consenso al relativo trattamento potrà come conseguenza l’impossibilità per l’utente di ricevere tali ulteriori servizi.

9. L’utente ha sempre diritto a che i suoi dati siano aggiornati, rettificati o integrati, la cancellazione, la trasformazione in forma anonima o il blocco dei dati trattati in violazione di legge ivi compresi quelli di cui non è necessaria la conservazione in relazione agli scopi per i quali i dati sono stati raccolti o successivamente trattati, l’attestazione che le operazioni sono state portate a conoscenza, anche per quanto riguarda il loro contenuto, di coloro ai quali i dati sono stati comunicati o diffusi, eccettuato il caso in cui tale adempimento si rivela impossibile o comporta un impiego di mezzi manifestamente sproporzionato rispetto al diritto tutelato.

L’utente ha diritto di opporsi, in tutto o in parte al trattamento dei dati personali che lo riguardano per motivi legittimi, ancorché pertinenti allo scopo della raccolta e al trattamento di dati personali che lo riguardano a fini di invio di materiale pubblicitario o di vendita diretta o per il compimento di ricerche di mercato o di comunicazione commerciale.

11. L’utente può inoltre revocare in qualsiasi momento il consenso al trattamento dei propri dati precedentemente dato a BIKEE BIKE SRL.

13. Alla prima visita l’utente sarà invitato a scegliere la propria lingua ed offrirà la possibilità di salvare la lingua di preferenza. A tal fine, l’utente autorizza l’utilizzazione dei codici di identificazione c.d. cookies, i.e. piccoli file inviati dal proprio internet server e registrabili sul disco rigido del computer dell’utente.

14. Il disco rigido raccoglie le informazioni sulla preferenza della lingua dell’utente e memorizza le pagine del sito visitate. I cookies sono utilizzati allo scopo di evitare che l’utente riceva la stessa informazione ripetutamente o nella lingua sbagliata, e per adattare il contenuto e la presentazione del sito al tipo di browser dell’utente.

1. Nell’ipotesi in cui una delle clausole delle presenti Condizioni Generali di Vendita fosse nulla per qualsivoglia motivo ciò non comprometterà in nessun caso la validità e il rispetto delle altre disposizioni figuranti nelle presenti Condizioni Generali di Vendita.

Art. 15 – Legge Applicabile E Foro Competente

1. Le presenti Condizioni Generali di Vendita sono disciplinate dal diritto italiano ed interpretate in base ad esso, fatta salva qualsiasi diversa norma imperativa prevalente del paese di residenza abituale del l’acquirente. Di conseguenza l’interpretazione, esecuzione e risoluzione delle Condizioni Generali di Vendita sono soggette esclusivamente alla legge Italiana.

2. Eventuali controversie inerenti e/o conseguenti alle stesse dovranno essere risolte in via esclusiva dall’autorità giurisdizionale Italiana. In particolare, qualora l’utente rivesta la qualifica di Consumatore, le eventuali controversie dovranno essere risolte dal tribunale del luogo di domicilio o residenza dello stesso, se ubicati nel territorio Italiano, in base alla legge applicabile.

2. Before placing orders and purchasing products and services from different parties, we suggest checking their conditions of sale.

Art. 3 – Conclusion of the Contract

1. To conclude the purchase contract, it will be necessary to complete the form in electronic format and send it following the relevant instructions.

2. It contains the reference to the General Conditions of Sale, the images of each product and the relative price, the means of payment that can be used, the delivery methods of the purchased products and the related shipping and delivery costs, a reference to the conditions for exercising the right of withdrawal; methods and times for returning purchased products.

3. Before concluding the contract, you will be asked to confirm that you have read the General Conditions of Sale including the information on the right of withdrawal and the processing of personal data.

4. The contract is concluded when the seller receives the form completed by the user, and the payment.

Art. 4 – Registered Users

2. The confirmation will in any case exempt BIKEE BIKE SRL from any responsibility regarding the data provided by the user. The user undertakes to promptly inform BIKEE BIKE SRL of any change in their data communicated at any time.

3. If the user then communicates inaccurate or incomplete data or even in the event that there is a dispute by the interested parties regarding the payments made, BIKEE BIKE SRL will have the right not to activate or suspend the service until the relevant shortcomings.

4. Upon the first request to activate a profile by the user, BIKEE BIKE SRL will assign the user name and a password to the same. The latter recognizes that these identifiers constitute the system for validating the user’s access to the Services and the only system suitable for identifying the user that the actions carried out through such access will be attributed to him and will have binding effect on him.

5. The user undertakes to maintain the secrecy of his access data and to keep them with due care and diligence and not to transfer them, even temporarily, to third parties.

Art. 5 – Product Availability

1. Product availability refers to the actual availability at the time the user places the order. This availability must however be considered purely indicative because, due to the simultaneous presence on the site of multiple users, the products could be sold to other customers before the order is confirmed.

2. Even after sending the order confirmation email, there may be cases of partial or total unavailability of the goods. In this case, the order will be automatically corrected with the elimination of the unavailable product and the user will be immediately informed via e-mail.

3. If the user requests cancellation of the order, terminating the contract, BIKEE BIKE SRL will refund the amount paid within 15 days starting from the moment in which BIKEE BIKE SRL became aware of the buyer’s decision to terminate the contract .

Art. 7 – Payment Methods and Prices

1. The price of the products will be that indicated from time to time on the site, except where there is an obvious error.

2. In the event of an error, BIKEE BIKE SRL will notify the buyer as soon as possible, allowing the order to be confirmed at the correct amount or canceled. In any case, there will be no obligation for BIKEE BIKE SRL to supply what is sold at the lower price incorrectly indicated.

3. The prices on the site include VAT and do not include shipping costs. Prices are subject to change at any time. The changes do not affect orders for which order confirmation has already been sent.

4. Once you have selected the desired products, they will be added to the cart. Simply follow the purchase instructions, entering or verifying the information requested at each step of the process. Order details may be modified before payment.

Art. 8 – Delivery

1. BIKEE BIKE SRL carries out shipments throughout Italy.

2. BIKEE BIKE SRL will only make deliveries to the user’s home, provided at the time of purchase.

3. Delivery is generally made within 3-5 WORKING DAYS for in-stock products

4. If delivery cannot take place for reasons not attributable to us after thirty days from the date on which the order is available for delivery, we will assume that the contract is intended to be terminated.

5. As a result of the termination, the amounts will be refunded, excluding delivery costs. Transport resulting from the termination of the contract may have additional costs which will be borne by the buyer.

6. Shipping costs are borne by the buyer and are explicitly highlighted at the time the order is placed.

Art. 9 – Passage of Risk

1. The risks relating to the products will pass to the buyer from the moment of delivery. Ownership of the products is considered acquired as soon as full payment of all amounts due in relation to them is received, including shipping costs, or at the time of delivery, if this occurs at a later time.

Art. 10 – Guarantee and Commercial Compliance

1. The seller is responsible for any defect in the products offered on the site, including non-compliance of the items with the products ordered, in accordance with the provisions of Italian legislation.

2. If the buyer has stipulated the contract as a consumer, i.e. any natural person who acts on the site for purposes unrelated to any entrepreneurial or professional activity carried out, this guarantee is valid provided that the defect appears within 24 months of delivery date of the products; that the buyer presents a formal complaint regarding the defects within a maximum of 2 months from the date on which the defect was recognized by the latter; that the online return form is completed correctly.

3. In case of non-conformity, the user who has stipulated the contract as a consumer will have the right to obtain the restoration of conformity of the products without charge, through repair or replacement, or to obtain an appropriate price reduction or termination of the contract relating to the disputed goods and the consequent refund of the price.

4. All return costs for defective products will be borne by the seller.

Art. 11 – Withdrawal

1. In accordance with the legal provisions in force, the buyer has the right to withdraw from the purchase without any penalty and without specifying the reason, within 30 days pursuant to art. 57 of Legislative Decree 206/2005 starting from the date of receipt of the products.

2. In the case of multiple purchases made by the buyer with a single order and delivered separately, the term starts from the date of receipt of the last product.

3. The user who intends to exercise the right of withdrawal must communicate this to BIKEE BIKE SRL by means of an explicit declaration, which can be sent by registered letter with return receipt to the address:

4. The buyer must exercise the right of withdrawal also by sending any explicit declaration containing the decision to withdraw from the contract or alternatively transmit the standard withdrawal form, referred to in Annex I, part B, Legislative Decree 21/2014 not obligatory.

6. The goods must be returned intact, in the original packaging, complete in all its parts and complete with the attached tax documentation. Without prejudice to the right to verify compliance with the above, Bikee Bike srl will refund the amount of the products subject to the withdrawal within a maximum period of 10 days.

7. The costs incurred for returning the goods will be borne by the user.

8. As required by art. 56 paragraph 3 of Legislative Decree 206/2005, amended by Legislative Decree 21/2014 Bikee Bike srl may suspend the reimbursement until receipt of the goods or until the buyer demonstrates that he has sent the goods back.

9. The right of withdrawal will not apply in the event that the services and products of BIKEE BIKE SRL are included in the categories of the art. 59 of Legislative Decree 206/2005.

10. Bikee Bike srl will carry out the refund using the same payment method chosen by the buyer during the purchase phase. In the case of payment made by bank transfer, and if the user intends to exercise his right of withdrawal, he must provide the bank details: IBAN, SWIFT and BIC necessary to make the refund.

Art. 12 – Privacy

1. By using the site the user authorizes the processing of his personal data. This information is also valid for the purposes of article 13 of EU Regulation no. 2016/679, relating to the protection of natural persons with regard to the processing of personal data as well as the free circulation of such data.

The user has the right to object, in whole or in part, to the processing of personal data concerning him for legitimate reasons, even if pertinent to the purpose of the collection and processing of personal data concerning him for the purpose of sending advertising material or for direct sales or for carrying out market research or commercial communication.

Art. 15 – Applicable Law and Competent Court

1. These General Conditions of Sale are governed by Italian law and interpreted on the basis of it, without prejudice to any different mandatory rules prevailing in the country of habitual residence of the buyer. Consequently, the interpretation, execution and termination of the General Conditions of Sale are subject exclusively to Italian law.

2. Any disputes inherent and/or consequent thereto must be resolved exclusively by the Italian jurisdictional authority. In particular, if the user qualifies as a Consumer, any disputes must be resolved by the court of the place of domicile or residence of the same, if located in Italian territory, based on the applicable law.
